Terms of Service

Thank you for using StatPotion.com (“StatPotion”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our websites, SDKs, APIs, documentation, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Services.
1. Overview and Definitions
- “Account” means a registered StatPotion account created by you to manage games and use the Services.
- “Developer” means the person or entity that signs up for an Account to use the Services.
- “Game” means any application or project you register or connect to the Services.
- “End User Data” means data related to your players/users that you or your Game choose to store using the Services (e.g., game save data, settings, pseudonymous player IDs).
- “Your Content” means content you submit to the Services other than End User Data (e.g., game names, schemas, configuration, feedback).
2. Eligibility; Accounts; Security
- You must be at least 18 years old to create an Account. If you use the Services on behalf of an entity, you represent you are authorized to bind the entity.
- You are responsible for safeguarding your Account credentials and for all activities under your Account. Promptly notify us of any unauthorized use.
- You must keep Account information accurate and up to date.
3. Services; Changes; Beta Features
- We provide storage and management of game saves and settings across platforms, along with associated tooling, SDKs, and APIs.
- We may modify the Services, introduce new features, or discontinue features with reasonable notice where practical. Material changes will be communicated via the dashboard, email, or our website.
- From time to time, we may offer pre-release or experimental features (“Beta”). Beta features are provided “as is,” may be subject to additional terms, and may be discontinued at any time.
4. Your Responsibilities
- Compliance: You will use the Services in compliance with these Terms, applicable laws and regulations (including privacy, consumer protection, and export laws), and platform/marketplace rules relevant to your Game.
- End User Transparency: You are solely responsible for providing any notices and obtaining any consents from your end users that are required by law for your use of the Services (e.g., for storing save data, cookies in your Game, or analytics you enable).
- Content and Conduct: You are responsible for Your Content and End User Data. Do not upload or store illegal content or content that infringes the rights of others.
5. Prohibited Uses
You will not, and will not permit others to:
- attempt to access the Services or related systems without authorization, or probe/scan/vulnerability-test systems without our express written consent;
- interfere with or disrupt the integrity or performance of the Services;
- upload, store, or transmit malicious code; or
- use the Services for unlawful activities, to violate intellectual property or privacy rights, or to collect or process special categories of personal data without appropriate legal basis and safeguards.
6. Intellectual Property
- Our IP: The Services, including software, SDKs, APIs, designs, and documentation, are owned by us or our licensors. Except for the limited rights granted in these Terms, we retain all rights, title, and interest.
- Your IP: You retain all rights to Your Content and End User Data. You grant us a limited, worldwide, non-exclusive license to host, store, transmit, display, and process Your Content and End User Data solely to provide and improve the Services and to comply with law.
- Feedback: You grant us a perpetual, irrevocable, worldwide, royalty-free license to use suggestions or feedback you provide without restriction.
7. Data; Privacy; Security
- Roles: For End User Data that you store via the Services on behalf of your Game, you are the data controller (or equivalent under applicable law), and StatPotion is a data processor. For your Account information and our own service operations, StatPotion is a data controller.
- Privacy Policy: Our collection and use of personal information is described in our Privacy Policy. The Privacy Policy is incorporated into these Terms.
- Security: We implement commercially reasonable technical and organizational measures designed to protect the Services and data within them. You are responsible for securing your integration, devices, and credentials.
- Data Processing: Where required by applicable law, we will enter into a data processing agreement with you. Contact support@statpotion.com to request a DPA.
- Data Export/Deletion: During your subscription, you may export your data. Upon termination, we will delete or anonymize your data within a reasonable period unless we are required to retain it by law.
8. Fees; Billing; Taxes
- Free and Paid Plans: We may offer both free and paid plans. Plan limits (e.g., saves/month, games) are stated on our Pricing page or in your dashboard.
- Billing: Paid subscriptions renew automatically unless canceled. You authorize us and our payment processor to charge applicable fees plus taxes. You can cancel in the dashboard effective at the end of the current billing period.
- Refunds: If you’re not satisfied with the Services, contact support@statpotion.com and we will refund the unused portion of your paid fees (pro rata) for the current billing period. Refunds are issued at our discretion, but we aim to be fair and responsive.
- Overages: We do not bill overage fees. If you exceed plan limits, we may throttle usage, limit certain features, or request an upgrade. We will make reasonable efforts to notify you before you hit limits.
- Taxes: Fees are exclusive of taxes. You are responsible for applicable taxes, duties, and government charges.
9. Third-Party Services
The Services may depend on or interoperate with third parties (e.g., cloud hosting, analytics, authentication). We do not control third-party services and are not responsible for their acts or omissions. Your use of third-party services is subject to their terms and policies.
10. Open Source and SDKs
Portions of the Services or SDKs may include open-source software. Such software is provided under the applicable open-source licenses. In the event of a direct conflict between these Terms and an open-source license for that component, the open-source license will control for that component.
11. Confidentiality
Each party may receive non-public information from the other. The receiving party will use such information only to exercise rights and perform obligations under these Terms and will protect it with reasonable care. Confidentiality obligations do not apply to information that is public, independently developed, or rightfully obtained from third parties without restriction.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT DATA WILL BE PRESERVED WITHOUT LOSS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL STATPOTION OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR ONE HUNDRED U.S. DOLLARS ($100) IF YOU HAVE NOT PAID ANY AMOUNTS.
Some jurisdictions do not allow certain disclaimers or limitations; to that extent, they may not apply to you.
14. Indemnification
You will defend, indemnify, and hold harmless StatPotion and its affiliates, and their respective directors, officers, employees, and agents, from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) Your Content or End User Data; (b) your Games; (c) your use of the Services in violation of these Terms or law; or (d) alleged infringement or misappropriation of third-party rights by Your Content or your Game.
15. Suspension and Termination
We may suspend or terminate your access to the Services if you materially breach these Terms, pose a security risk, engage in fraud or illegal activities, fail to pay fees, or if required by law. You may terminate at any time by canceling your subscription and ceasing use. Sections that by their nature should survive termination will survive (including payment obligations accrued up to termination).
16. Export; Sanctions; Government Use
You will comply with all applicable export control and sanctions laws. You represent that you are not located in, under control of, or a national or resident of any jurisdiction subject to comprehensive sanctions or on any restricted list. The Services are “commercial items” under 48 C.F.R. §2.101; government use is subject to these Terms.
17. Children
The Services are not directed to children under 13. You will not use the Services to collect personal information from children under applicable age-of-consent thresholds without appropriate parental consent and compliance with applicable laws (e.g., COPPA, GDPR).

Notices will be provided via the dashboard, email to your registered address, or our website. You may contact us at support@statpotion.com for legal notices and support.
19. Governing Law; Venue
These Terms are governed by the laws of Sweden without regard to conflict-of-laws principles, except where mandatory consumer protection laws applicable to you say otherwise. If you are a consumer located in a jurisdiction with non-waivable consumer protection rules, those rules will govern to the extent they cannot be waived by contract. The exclusive jurisdiction and venue for any action relating to these Terms or the Services will be the courts located in Stockholm, Sweden, and you consent to personal jurisdiction there.
20. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by posting on our website, via the dashboard, or via email. Changes become effective on the stated effective date. If you continue to use the Services after the effective date, you accept the changes.
